We have established the following guidelines to ensure the quality of the auctions and services on this web site. Sellers and buyers are responsible for all aspects of the transactions in which they choose to participate. All transactions conducted on this web site must be consistent with any applicable legal rules and with this web site's guidelines, Terms of Service and user agreement.

This web site reserves the right to reject or remove any ad that is not consistent with the letter or spirit of this web site's policies or the law. Please review the guidelines below and make sure any transactions you conduct comply fully with these guidelines as well as with our site terms of service and user agreement.

General Information

This web site provides services as a platform for our users to connect with one another. This web site does not participate in, nor is it a party to, any transactions. This web site does not screen or control users who may sell or buy on Crafts.la, nor does this web site review or authenticate all listings, items, or services offered for sale. Therefore, users of this service should be aware that:

* Sellers and buyers are completely responsible for working out the sale and exchange of goods or services.
* Sellers and buyers must resolve any disputes that may arise from transactions. It is important to use care throughout your dealings with other people using our services.
* Sellers and buyers should deliver purchases via mail or a shipping service, or by meeting in a public location. Sellers and buyers should never allow strangers to their homes to conduct transactions. Good meeting places are at your local Police Department or Sheriff's department or any other crowded area that provides security.
* Sellers and buyers are responsible for researching and complying with any applicable laws, regulations or restrictions on items, services, or manner of sale or exchange that may pertain to transactions in which they participate.
* Sellers and buyers are responsible for all applicable taxes and for all costs incurred by participating in the classifieds.

General Rules

1. Fraud. You may not use or manipulate this service for any fraudulent activity or purpose, including collecting payment from buyers and not providing the item or service purchased, or filing false claims for insurance payments.

2. Interference. You may not spam our system and/or impose an unreasonably or disproportionately large load on our system. You may not put any material on the site that contains any viruses, trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information. You may not solicit this web site's users to use services provided on other web sites.

3. Passwords. You are solely responsible for actions taken under your password and should not disclose it to anyone else. You cannot use your password for any unauthorized purpose.

Prohibited Items

Crafts.la provides services for artists and crafters. All materials posted for sale on the site or sought through the wanted ads must be arts & crafts related. Crafts.la is not a "general" auction site, and as such, "general" items are forbidden. We do allow "general" items in the supplies and books & magazines category so long as the item can be used by artists and crafters.

For Example: A typical plate is prohibited from being listed in all categories unless it is handmade. If it is not handmade, then it may be placed in the "Supplies > Recyclables" category as a plate meant to be broken into pieces for Mosaic work. When posting general items as a recyclable supply, one should always specify the reason why it is being sold as a supply for crafters. A seller could do this by placing something like the following in the item description "This plate is intact so that the winning bidder can break it into properly sized pieces for their mosaic work".

The following list of prohibited items is a sample only. Crafts.la reserves the right to prohibit the listing of any item, at any time, if the site administrator, at his or her sole discretion, determines that the item is harmful, offensive, or illegal.

Posting an item that is prohibited may also result in your account being suspended at Crafts.la. The decision of the site administrator to remove an auction or ad or to suspend a user from the site is final and not subject to appeal or review.

IMPORTANT: LISTING ITEMS THAT ARE HARMFUL, OFFENSIVE, OR ILLEGAL MAY SUBJECT YOU TO CRIMINAL OR CIVIL PROSECUTION.

It is impossible to list all items that might be considered harmful, offensive, or illegal. Users are requested to use their common sense when deciding whether to post an item that might fall into these categories.

Even if you offer to give away for "free" or offer to "swap" (rather than sell) a prohibited item, this will not relieve you of liability or absolve your from the responsibility of complying with the User Agreement. This applies to both user and buyer.

These guidelines do not constitute legal advice. If in doubt, check with law enforcement agencies, an attorney or with a copyright, trademark or other rights owner for clarification. Crafts.la has also adopted certain policies regarding prohibited items, regardless of the legality of the item.

As a Crafts.la user, you are ultimately responsible for making sure that buying or selling your item(s) is legal in the eyes of the law. If you think you've spotted an item that is not allowed, please click here to contact us.

Sample List Of Prohibited Items:

Offensive material, including but not limited to pornography, child pornography, x-rated videos, dvds, book, magazines or movies, adult toys or any item considered "adult" or "sexual" in nature.

Firearms, weapons and related items including but not limited to scopes, switchblade knives, ammunition, BB guns, slingshots, tear gas etc.

Medication and Drugs including over the counter medications, prescription drugs, illegal drugs or any form of controlled substance or drug paraphernalia.

Explosives, fireworks, sparklers and other items of this nature.

Medical devices, including but not limited to prescription or contact lenses, defibrillators, hypodermic needles or hearing aids.

Offer or solicitation for dating, escort services or illegal prostitution.

Stolen property, or property with altered or removed serial numbers.

Alcohol of any nature

Tobacco products

Live animals, livestock or insects

Human or animal blood, bodily fluids or body parts.

Tickets, coupons or gift cards which you are not authorized to sell.

Used bedding and clothing, unless sanitized in accordance with law.

Embargoed Goods

Food

Freon

Credit Cards

Counterfeit Items or products and materials used to make counterfeit goods, including but not limited to money, tickets, stamps, designer clothing and accessories.

Restricted or regulated plants.

Pesticides or hazardous materials.

Lock Picking Devices or Burglary Tools

Government IDs & Licenses including but not limited to items with police insignia, citizenship documents, or birth certificates.

Illegal telecommunications equipment.

Items that infringes copyrights or trademarks, including but not limited to digital goods, music, movies and other related goods that you are not authorized to sell.

Gambling items, including but not limited to lottery tickets, sports trading card 'grab bags', raffle tickets, sweepstakes entries or slot machines.

Bulk email or mailing lists that contain names, addresses, phone numbers, or other personal identifying information

Selling

All sellers must:

1. Comply with applicable laws. You may not offer for sale or sell an item or service to any buyer in a jurisdiction where the item, service, or terms of the sale violate applicable laws or regulations.
2. Provide accurate information. You must accurately describe the item you are selling. You may not include any language in your listings, including the ad title, which may confuse potential buyers or cause your listing to be included in search results to which it is not responsive.
3. Place item in the appropriate category. You must list your item in the most appropriate category. Each item can only be listed in a maximum of two categories. When listing an item in two categories, the item should still be appropriate for both categories.
4. Avoid inappropriate ad content. You may not link to, post, or include advertisements for goods or other materials that: (a) describe items or services that you are not selling at Crafts.la, or (b) you do not have right to link to or include. You also may not include any content or images in your ad that are obscene, offensive, harmful to minors, invasive of anyone's privacy, or otherwise inappropriate. You are allowed to place a single link to your own personal website or blog in your listings. If you opt to place a link to your website or blog in your listings then you may use no more than 100 characters for your link and description of your website or blog. Under no circumstances are you allowed to link to other sites that are not your own, this includes affiliate links, auction sites or other sites that do not belong to you. If you do not have a website or blog, we do allow links to your Etsy store but this is the only 3rd party service that we allow links to. We allow Etsy because they also provide a service to crafters exclusively and we wish to show our support of any service that helps artists and crafters like ourselves.
5. Have the rights to and possession of item. You may not offer any item for sale that is not in your possession, you do not have the right to sell, or that does not exist at the time of the ad.

Spam

This web site encourages you to post listings and wanted ads as long as they are not duplicates or other forms of spam. This web site may take action to delete listings or wanted ads and/or user accounts that we believe are misusing this service. Prohibited spam or otherwise impermissible marketing activities may include, but are not limited to, the following:

1. Posting a listing that is unrelated to the category in which the listing is placed.
2. Posting identical listings in the same category.
3. Posting listings with inappropriate links, titles, descriptions, or unauthorized use of content to which the person posting does not have rights.
4. Posting a multi-level marketing position or other non-traditional job not involving a W2 or 1099.
5. Posting a listing for the sole purpose of collecting user information or raising money.
6. Posting a listing that contains unsolicited or unauthorized advertising or promotional materials. This may include an ad that instruct the user(s) to contact the person/company posting the ad for more information and then require the user to pay a fee for that information.
7. Posting a job related listing that requires a monetary investment by the user at any time.
8. Posting a listing through unauthorized robots (crawling software).

This web site's Right To Terminate

This web site, in its sole discretion, may terminate any listing or wanted ad or your user account immediately and without notice if (a) this web site believes that you have acted inconsistently with the spirit or the letter of this agreement, or (b) this web site believes you have violated or tried to violate the rights of others. If you see a listing that violates our rules, please let us know by contacting us.

Disclaimer of Warranties

ALL CONTENT, SOFTWARE, AND OTHER SERVICES PROVIDED AT OR FOUND WITHIN THIS SITE BY CRAFTS.LA AND ITS AFFILIATES ARE PROVIDED "AS IS" AND "WITH ALL FAULTS," WITHOUT WARRANTIES OF ANY KIND, AND CRAFTS.LA AND ITS AFFILIATES HEREBY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT. SPECIFICALLY, BUT WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, CRAFTS.LA DOES NOT MAKE ANY WARRANTIES REGARDING THE FOLLOWING: (a) AVAILABILITY OF THE SITE AT ANY PARTICULAR TIME; (b) ACCURACY OF THE CONTENT OR HOW CURRENT ANY CONTENT IS THAT IS FOUND ON THE SITE; (c) TRANSMISSIONS TO, FROM OR WITHIN THE SITE; (d) FUNCTIONALITY; (e) LACK OF VIRUSES; (f) COMPLIANCE OF THE SOFTWARE, SERVICES AND CONTENT PROVIDED UNDER THIS AGREEMENT WITH UNITED STATES, FEDERAL OR STATE LAWS; OR (g) THAT THE SOFTWARE, CONTENT OR SERVICES CONTAINED IN THE SITE WILL MEET ANY PARTICULAR CRITERIA OF PERFORMANCE OR QUALITY.

IN NO EVENT WILL CRAFTS.LA OR ANY OF ITS AFFILIATES BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, OR SPECIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF OR UNAUTHORIZED ACCESS TO INFORMATION, AND THE LIKE, EVEN IN THE EVENT OF FAULT, TORT, BREACH OF CONTRACT, OR BREACH OF WARRANTY, AND EVEN IF CRAFTS.LA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
